What is the Regulation of Property Agents (RoPA)?

The Regulation of Property Agents (RoPA) is a government-led initiative which states that “property agents should be regulated by an independent regulator, with mandatory qualifications and a code of practice.” These regulations primarily target estate agents in the UK and managing agents in England.

Housing Minister Matthew Pennycook said in October 2024 that “the Government is committed to ensuring that those living in the rented and leasehold sectors are protected from abuse and poor service at the hands of unscrupulous property agents.”

When will the RoPA be introduced?

There is currently no confirmed timeline for RoPA to become law. However, a February 2024 inquiry led by Baroness Taylor highlighted the urgency for swift action. The inquiry explored:

  • The potential establishment of a new regulator for property agents
  • The effectiveness of existing redress schemes
  • Whether the regulator’s scope should include landlords and freeholders in addition to property agents

How Are Letting Agents Currently Regulated?

Letting agents in England are not currently subject to statutory regulations or specific licensing requirements, but since 2014, letting agents became members of redress schemes. This enables tenants and landlords to file complaints, with local councils authorised to enforce fines of up to £5,000. However, complaints remain high, with nearly 14,000 recorded in 2022.

According to Propertymark, tenants often complain about unfair or excessive letting fees. Transparency is key, as agents should clearly disclose fees related to landlords, unusual charges (e.g., check-in/check-out fees or security deposit handling fees), and repair or maintenance costs.
