How to notify tenants of a new property owner (Section 3 Notice)

This blog will explain what information you must provide to the tenants when there is a new property owner and will briefly outline the relevant legislation.  

 

A new property owner is legally required to notify tenants of the following:  

 

 

  1. The new property owner’s full name  
  2. Property owner’s address  
  3. An address where notices and other documents can be served by the tenant to the property owner (this is often the same as the property owner’s actual address) 

 

 

Section 3: 

Section 3 of the Landlord and Tenant Act 1985 states that property owners are legally required to notify tenants that they are the new property owner and provide their personal contact details. This is usually a requirement after buying property with sitting tenants. The notice does not need to be in any particular format as long as it contains the relevant information as outlined above. The notice should be in writing and should be given no later than the next day on which rent is payable under the tenancy or, if that is within two months of the assignment, the end of that period of two months. 

 

 

If you fail to comply with section 3:  

 

  1. You risk being fined up to £2500. 
  2. The previous property owner and the new property owner will both be held responsible for any breaches of the tenancy agreement. The previous property owner can avoid being impacted negatively by the incompliance of the new property owner by providing their own notice in writing and providing the new property owner’s contact details.
