How to check the validity of Section 21 notice:

Check the form and dates:  

 

Firstly, you should check the dates and the type of form thoroughly. The Section 21 notice must be on form 6A. It is also important to know that the notice will be invalid if you have been waiting for a long time to apply to court and if you have issued the notice in the initial 4 months of the original tenancy.  

 

Section 21 notice invalid if deposit is not protected: 

 

Section 21 notice will not be valid if the tenants deposit has not been protected under a scheme or if it was protected later. It is usually considered late deposit protection if it was protected more than 30 days after the most recent contract started.  

 

3 documents required for a valid notice:  

 

The following 3 documents must be shared with tenants for the Section 21 notice to be valid:  

  • Gas safety certificate 
  • Energy performance certificate (EPC) 
  • The government’s How to rent guide 

 

Notice is invalid if you have charged banned fees:  

Property owners and agents can only: 

  • take up to 5 weeks’ rent as a deposit 
  • charge fees under specific circumstances 

 

Notice is also invalid for the next 6 months if council orders renovations:

The section 21 notice will be invalid for the next 6 months if the council orders you to do repairs under either an: 

  • improvement notice 
  • emergency works notice
